Fair Usage Policy

Bloume includes AI features as part of our service provision to eligible subscribers, our AI is available via our Aiya functionality within the Bloume app. Aiya is intended to act as a supportive voice, and guide to our core product offering and to facilitate content access and application usability, Aiya is designed for normal day-to-day use by the average consumer within the scope of the subscription tier purchased by the consumer and as detailed in the relevant terms and conditions of the subscription agreement.

As part of our commitment to reliability, access and responsibility our Aiya functionality is subject to this fair usage policy. Fair use is not determined by a single standalone factor but is assessed on the basis of overall pattern of behaviour and volume of usage for individual consumers, including the number of Aiya prompts or conversations engaged in comparison with the overall app usage.

Excessive usage may be determined where such behaviour materially exceeds what may be considered normal in comparison with similar application usage levels, where it generates disproportionate usage costs relevant to the AI infrastructure or where such usage impacts service or function performance or availability. Usage may also be considered excessive where it materially breaches acceptable use parameters or seeks to circumvent product safety and controls including but not limited to the generation of harmful content or to invalidate the rights and freedoms of others.

In the event that excessive usage is determined, Bloume will notify relevant consumers when such usage reaches or exceeds this threshold with not less than 30-days notice except in extreme circumstances where such usage was exponentially exceeded. In addition, Bloume may implement temporary or ongoing technical controls to limit such usage to within fair usage parameters, including but not limited to, rate limits, throttling or queuing or alternatively, may offer such users additional Aiya functionality through appropriate tiered subscription plans to ensure fair access for all consumers of our product. Consumer will be notified via the Bloume application and afforded reasonable opportunity to respond or dispute any such controls before application of such.

The Aiya Fair Usage Policy may be updated from time to time in response to changes in AI infrastructure and capabilities, model-provider pricing or controls and applicable laws or regulatory changes as well as in response to consumer usage patterns and behaviour. Material changes will be notified to all consumers via our Bloume application with not less than 30-days notice.

Rights expressly granted to customers under applicable law or subscription agreement are not impacted by any content within this fair usage policy.
